Medical Malpractice claims are a special niche of standard “negligence” claims involving an allegation that a doctor or other medical provider failed to live up to the standard of care required by his or her profession. These claims often involve highly specialized areas of medical knowledge and often revolve around expert witnesses. As a result of the frequency of medical malpractice litigation, as well as the public policies inherent in medical care, states often have extensive legislation regarding these sorts of claims.
